most of the people in india will be happy that this is happening to us....and that means people at the embassy also....

i dont blame them though, who will feel good when you say that you dont like their country and you want to migrate to another country, and on top of that they can see how good life is over here, and most of them can't apply for immigration...since they wont qualify...
 
Why doesn't someone get Rajiv involved in this. He has considerable influence in such matters and would know how to put it. When it comes from a high-powered lawyer, everybody listens. I would not be surprised that the phone messages never get thru to the senators.
 
Probably Rajiv would like big bucks in order to take part in anything...

I am trying to find info on that myself.
Perhaps someone could call Sen. Specter office ? I am at work. I can call later today, although I am wondering that if you had any positive outcome, immigration-law and others will post it soon.

However, we still need the budget reconciliation to be approved in
Senate and full house for it to become effective - so we have to cover
some distance.

Folks it passed this phase. Obviously there is more work ahead to get this signed into law. We should call the Senators and thank them, especially Sen. Specter.

I will see if I can find out what is the outlook and time frame for next steps.

Today was a small victory. We have lots of work to do though.

Now its time to educate (and show strong support) to our state senators/congressman about "immigration relief provisions" attached in budget reconciliation so whenever full senate and congress meet for voting, they know enough background (and importance/urgency of immigration reliefs for EB categories) and vote in favour!!

Guys I want to make sure I understand this correct.

The proposed bill passed the SJC and will now go on floor to both the houses. So we should be calling our local senators and congressmen to support/pass the bill.

If the above is correct :

1. Can someone point me to the Bill number or id or whatever, so when I (we) call these ppl I (we) can talk intelligently.

2. Are there any dates proposed for this bill to be heard on either houses, and can someone help with that info? If there are none yet, is there someone we can call to ask them to help schedule this. (some committee??). pardon the ignorance.

3. Was there a breakup of yay/nay in the SJC or was it unanimous? This might help if we were to call either republicans or democrats, good to know what their thought process is.

The bill being atleast passed by SJC must a crushing blow to the always-whiners, and shot in the arm for many of us trying to do our bit. Positive news is like a red bull!!! Keep it going.
 
A reliable lobbying source told me this morning the proposal that exempt dependents from the visa number headcounts have passed as well. That's what matters for the greencard folks. I am surprised it was not outlined the article which link you pasted below.

In today's executive meeting of Judiciary Committe, the Budget Reconcilliation proposal was passed with 13/3. I have confirmed it by calling the Judiciary Committe office (202-224-5225). You have to understand that this is NOT a bill but simply a proposal in the Budget Reconcilliation Bill. This bill is still in pre-hearing stage hence there is no number (S.xxxx) or exact details to it. After today outcome it will go to Senate Floor and House for debat, unfortunately timeline for that cannot be predicted.
The only way to know the outline of today's discussion is to talk to someone who attended the meeting. I have asked Judiciary Committe office about the transcripts but I was told that it won't be available for atleast a week.
There are some pointers about what has been discussed, most notable was H1B visa number increase to 30,000 after Fienstien Amendment to the original proposal of 60,000. Details...

I485/EAD/AP for retrogressed categories

What happen to other proposal - allow to file I485/EAD/AP for
retrogressed categories and adjust status only when visa available?
 
Kewl, Yes you are right, so far all the stuff I have read on the web is about H1-B cap increase and about getting the brightest minds here, blah blah..but what about all the bright minds already here ? Has no mention been made to the countless sufferers who are here, there should be something done about the 140/EAD proposal or atleast increase in visa numbers..I wonder if this was brought up / included in the meeting today ?

I think people like Rajiv Khanna can help us, I read a post where someone has said that he will just go after big bucks, first of all, if every person who visits this site can shell out 100$ each, it amounts to a lot, secondly, he is not making money out of this site, its a great service and help to all of the people who come here everyday, so lets stop procrastinating.

Guys:

I was out of office the second half of today. Was eagerly waiting to learn about today's outcome.

It is GREAT news!! Kudos to everyone here who have kept the spirits high. Apparently our efforts over the last two weeks must have had some impact.

Of course this is only an endorsement of the provisions to be included in the budget bill. The bill in itself has to be passed by both houses before it becomes law. We perhaps to wait another week to find out if the I-140 clause also made it.

My only concern is that when the final bill becomes law they should not drop the Green card relief provisions and pass it with only the increase in H-1B numbers.

A similar thing happened with the recent recapture of numbers for Schedule A occupations. The original bill had an additional number for other occupations, but the tech lobby lost out and only the 50000 increase was given to Schedule A (nursing). We have to keep the momentum going....
 
Retrogression

Before Accepting Bill:

140000 people are getting green cards including spouses and children

After Acceting Bill (On Average 2 Persons per a petition --Primary and spouse)

(140000 +90000) *2 > 460000 people will be getting Green card per year.


For India

There will be 4604 Visa Numbers per category per year will be available as per new calculation which does not include spouses and children.

It is lot better than before but based on this it does not seem like retrogression will end...

Only if we get some thing like removal of country limit then every one will benefit...
My Guess EB2 and EB1 will be out of retrogression... But all the problems will be with our EB3 numbers...

Even for EB3, even though it may not be current, a PD of 2003 or thereabouts is MUCH better than 1998?? And forward movement also should be better than otherwise.

I suggest we start a fresh thread to capture next steps. That is calling local senators/congressmen to them to support this bill (whenevr a S.XXXX num becomes available)

Just read in http://www.immigration-law.com/ Q & A link. According to them the I-485 filing clause possibly made it too.

Here it goes:

Q82: The Senate Judiciary Committee passed immigration proposals yesterday, October 20, 2005. I see that one of the proposals includes a provision that allows aliens to apply for I-485 before an immigrant visa number is deemed currently available. Can you tell me whether this provision will apply to those whose labor certification has already been approved or I-140 petition has been approved, but could not file I-485 applications?

A: We do not have details of this specific provision, but it is almost certain that the current waiters for the visa number availability to file I-485 may be covered by this bill if it is enacted into law. Besides, all those over 300,000 labor certification beneficiaries who are currently stuck at the Backlog Centers will be able to file the concurrent I-140/I-485 together with applications for EAD and Advance Parole as soon as their labor certification is approved. For the PERM filers, of course, they will be able to file such concurrent I-140/I-485/I-765/I-131 as soon as the PERM application is certified. All those RIR and PERM beneficiaries will also be allowed to change employment after 180 days of filing of their I-485 applications regardless of the visa number availability! One interesting question is how this bill affect the importance of priority date. The answer is that it will drastically reduce the value of the priority date in that the only difference which the priority date will make between those who filed (RIR)with an earlier priority date and those who filed (PERM) with a much later priority date will be just different waiting times. When it comes to the immigration benefits, such as EAD, AP, and AC21 change of employment after 180 days, the people in these two different groups will enjoy the same! What a marvellous proposal!

Why everybody is talking about calling Senators? Why they should listen to you, you guys are no citizens of US. May be they will listen to u as courtsey.
But why would they take any action? They will not.
