Hi, I am a USC and made GC petition for my husband. I-130/485 receipt of notice date was Sep. 2004. We had an interview with DAO, who was pregnant and kept burping after her lunch, by December 2005 without any attorney. She quoted about my husband's former AOS, which was withdrawn 6yrs. ago, and asked us more evidences(I-72). We hired an attorney and responded back to her with enough evidences, but she sent the letter to intent to deny and indicated to burden of proof is ours. My attorney replied back, and she denied I-130/485 with filing info. for appeal. The attorney filed MTR/Appeal to BIA within 15days with very crucial evidences by April 2004. Since then no adjudication was happened, neither MTR granted nor forwarding to BIA. I-765/131 were filed last October, and also were denied due to no I-485 pending. Contacted Senator, and a liaison officer replied that my husband's back ground check is pending for MTR. Also she noted that it takes sometimes for years. It is a very typical response from CIS recently that they point to another agency, FBI. It seemed the CIS officer just put the case into there after receiving appeal application. Look, how much we have spent for exhausting time, filing fees and attorney fees so far. He charged even email exchanges with no progress, and slowly responsed. Therefore, we conclude that we have to nothing but lawsuit against CIS due to willingful delay. We will spend a cost to sue a government agency which we paid for through our taxes. What an irony...

Who created this was happend? It should not be God.

I can't understand why they deny marriage based GC when no fraud can be proved.
Also isn't it cheaper to just apply again instead of suing and wasting your energy?
 
Hmm,, refiling

To refile, I have to withdraw the current Appeal/MTR. Otherwise the refiling may not work. Always starting over is painful... however we never expected that much longer time taken for 16 months..
