Is this lettter okay?

My lawyer recently send application for my GC. My original I-94 (given at airport) expired in April 2002 but the H1 transfer came with a new I-94 valid till Sep 2003. My company lawyer sent the following cover letter to INS:

"... please find following document:
1. Photocopies of both sides of Form 1-94 as evidence of inspection and admission.
2. Evidence to establish that applicant has maintained lawful non-immigrant status since entering USA:
a). EAC- 01-xxx , H-1B approval notice valid till Sep 2003
b.EAC -xxx
..."

My q is that the is this good letter . Or will INS get confused after seeing my I-94 ( that already expired in 2002 april: app. was filed in July ). and concluding that I am out of status.
The HI-B approval in point a). contains the new I-94 valid till Sep 2003.

Yes you are out of status. you need to get a fresh I-94 by re-entering with the new h-1

When you post a question that is a trivial matter and confuse people...:)
The letter is fine.
You are not out of status.
Here after wards the I94 that came with h1 approval determines status. Both I94s will
-either have the same number
- or they would have been cross referenced by INS.

So No Worries...

BTW, learn what stage of GC you are entering into. GC is a sweeping word...
