I got a RFI (06/19/2004) for my EB1-OR petition ( TSC, ND 03/12/2003) and the RFI asked for a copy of my I-94 showing the NSEERS registration and Fingerprint identification number. They received my response on July 2nd, I waited until October 7 and sent out a case status inquiry. The online message has just been changed like this:

"On October 27, 2004, we responded to your request for more information concerning your case. If you have not received our response within 30 days from this date, please call customer service at 1-800-375-5283."

Is this a bad news?

Name Check/Background Check for I-140

Does anybody know whether USCIS runs name check or background check for I-140 approval.

4 months after Request for Info

I have been waiting for more than 4 months after responding to the Request for Info [TSC]. Is this a normal wait time?

Usually you will hear within one or two months after additional evidence submission. Call USCIS, what is going on. If it is NIW case, it is not a good sign. Good luck!

We already sent a case status inquiry and they responded. We are waiting for the letter. This is EB1-OR case not NIW.

My lawyer thinks the delay is something to do with the background check.
