NO if you send RFE documents back by the date they gave you. If you miss the deadline your case will be dismissed I think.

One has to be "eligible at time of filing" a visa petition when there is a "priority date" at issue. Any denial for ineligibility "at time of filing" will prevent you from acquiring a "priority date" to begin with. This is significant for later transfers, conversions, grandfathering, or retention of priority dates. The mere issuance of an RFE is immaterial. It depends on the substance of the request as to whether it would result in the loss of the priority date associated with that particular visa petition.
