Is there a time limit to file I-485 after I-140 approval ?

Hi all,

This forum has been of great help. I would like to know if there is a time limit by when i need to file my I-485 from the time of I-140 approval.

I have my I-140 approved on Sept 30, 2004 (EB2 - NIW). I would like to delay filing I-485 till my marriage. I am currently on H1-B. I will need to file I-485 in CSC and the I-485 processing times seems to be short these days (3 months) so i would like to delay filing I-485 if possible. I have heard some people say i need to file I-485 within 9 months from I-140 approval but not sure.

There is no time limit to file I-485 as long the GC job offer is valid and available. Whatever you heard is wrong.
But if you are getting married very soon, I would recommand you to file I-485 now, without doing delay. You can file your I-485 and delay your I-485 process other ways too. For example, postponing finger-print or not providing medical checkup record with initial I-485 application (as a result you will get RFE and you can delay upto 2.5 months to reply RFE).
 
Pralay- Thank you very much for the clarification and creative suggestions. I have one question regarding postponing finger printing. Do i need to submit a special form to do this and if so when i do i need to do this? Also, are there are time limits of how much i can postpone finger printing ?

After applying I-485 you will receive FP notice. In that notice there is a section for postponing your FP date. You just need to fill-up that part and mail it back to USCIS. While mailing it back, send it in certified post so that you have proof that you remailed it to postpone the FP date.
