Gurus,
My RD is 18 Feb 2002, got laid off after completing 180 days, right now working as contractor (w-2 basis) for company A, I am going to get good offer(Permanent) from another company. Is this safe time to change employer in case I get offer.
Thanks

Since you have crossed 180days, and have been laid off, you are fine with moving into another company [AC21]

I think the question will be what happens if there is an RFE asking for 6 paystubs and let's say there is gap of one month between both the jobs.

Can we present the paystubs for both companies with gap in between or do we have to wait another coupple of months to accrue more paystubs from the new company before responding to the RFE ?

Thanks

An RFE has to be replied to in 12 weeks, that is about 3 months. They usually ask for 4-6 paystubs (that would be 2-3 months salary info). So you should be covered as long as you receive the RFE after joining the new job.

Will it effect if I send 3 months paystubs from old company and 3 months paystub from new company in case of 6 month paystub RFE

if there are no breaks you will be fine. If there are breaks - talk to your lawyer. And BCIS usually does not ask for 6 months paystubs - they might ask for 6 paysubs.

So it means that if there is any break between the job change then it could be a problem. But I am wondering why would BCIS
care about the break as GC is meant for future employment and if you have job as per today then there should be no problem.

I was asked for 3 pay stubs.

I get paid monthly. I was asked for 3 months pay stubs and employment letter.
