This posting I saw in the general area. Does this mean that PD is different for each center or approval is done even if not current.

Wednesday Questions

2. I filed my I-485 in Dec\'99 under EB-3 from India. My priority date is July\'98, and the dates for EB-3 got retrogressed in 2000. What happens to my I-485? Will it be in pending until my priority date becomes current or it does not matter because it is already pending? Will we need to refile everything again?

A- The most recent INS guidance on this suggests that they will treat these as they have in the past: petitions filed while current but which retrogress are "held in abeyance" by INS till the dates become current. You remain an adjustee, able to get your work and travel authorization renewed, during this time. You will NOT need to start from the beginning!

I think people are just playing with other peoples emotions. I generally not worry too much about such impossible kind of cases. For all you know, it may be true sometimes due to an INS error. All applications are looked at by human beings, and they do this all day. Each officer may be processing 100 or more cases everyday. So, sometimes it is possible that they forget to go through each and every item related to the application.
