Is parole only (without EAD) ok to travel to India ?

Hi Guys,
I have scheduled trip to India in next few days. I have filed for my 485 and also filed for an extension for H1. I Expect it to come before I travel but as an alternative if the H1 doesn\'t come in time, I want to take parole and travel. Mind you, I won\'t have an EAD or and valid H1. Is that enough for travel or do you think there could be a problem.

Yes. EAD is not a compulsory thing to travel outside. BUT, when you return back, imagine this (remember you do not have EAD or H1).
Officer: Do you have a valid re-entry permit ?
You: Yes, I have an Advance Parole.
Officer: Are you working in US ?
You: Yes.
Officer: On what status ? H1 ? EAD ?
You: ?????? (Now, you realize that you are not supposed to work without some kind of work permit)

If you are working here, it is very likely that you will have to show a proof for authorized employment. It is better to have your approved H1 before you try to reenter

Ninja I agree with Kiran & Niki you should get your H1 apporval or your EAD card before you make any moves...

When I was travelling back from Bombay airport on AP, I showed my AP to immigration officer at Bombay Airport. He was asking for some more evidence, I showed him the EAD card, then he was OK. Technically it is not required, but I feel one should carry with him. At JFK they did not ask for it.

Also, if you use your AP for entering into the US, you are considered paroled into US and you forgo your non immigrant status therefore you have to start working on EAD. You can not use H1B after using AP.
