Is now an extraordinary circumstance for H1-B extension ?

Hi,

  My H1B expires in a week. I was wondering whether we could apply for an extension based on the current situtation. I have the co-operation of the employer and client, but was not sure whether it would be prudent to attempt for an extension.

Yes, if your GC process is pending for the past one year, you are eligible for H1-B Extension.

What do you mean by GC process pending? I guess so far I\'ve heard LC pending more than 365 days doesnt count itself unless at least I-140 has been filed before your visa expires. Do you know a case where LC was pending for more than a year WITHOUT filing I-140, got 1 year extension?

I don\'t remember a lot of nuts & bolts about such situation. However, I remember from one attorney\'s newsletter that the safe harbor is "I-140 being filed."

When I posted "GC Processing" I addressed it at a higher level (as the first line of this posting says, don\'t know a lot of nuts & bolts). If my posting did not help much, I guess more posts need to be awaited for.

Moreover, the original posting by "toprasad" explains little if he is/she is pursuing GC at all.
