Is new employer support required for AC21

As long as my new job is similar in descrtiption to my old job, does my new employer have to support my 485 case for me to successfully use AC21 to change jobs?

What I heard from my lawyer today is that it's not so much "support" but they may have to be able to meet the same criteria that was required for the original I-140 (ie. ability to pay from LC date, etc.).
