Is my Wife's status Legal?

Hi,

We both applied for I-1485( im primary and my wife beneficiary) in July-2004. At the time we applied my wife is in H4 visa. She got EAD and AP approved. Now her H4 expired and my H1B 6 years also expired same date in May-2005. I am using EAD. My wife never used her EAD. We never extended her H4 visa.

Is she in legal status? please verify :confused:

As long as her H4 was valid at the time of 485 filing, your wife's status is legal. You would need AP to travel in and out of country. EAD is needed if she is planning to work, otherwise is in another piece of glorified ID card.
 
H4 using EAD

Hi All

I am on I/140, I-485 stage, got EAD and APs for both me and my wife.
I am not using EAD still maintaing my H1 status.
If my wife who is on H4, gets a job and wants to use her EAD, is my status (h1) automatically changes to EAD?

Is it possible for my wife to go back to H4 from EAD in future if something goes wrong with my GC?

Your wife using EAD will not cause your status to change. About whether she can change back to H4 from EAD, I dont know if is is possible.
