I submitted my family based I-485 in Jan 2005 and only had my interview in May 2006 at the Philadelphia office (they lost some of my docs and I had to re-apply). Since then I have been told that my case is in background check status. I keep receiving these letters from them stating that I need to check back in 6 months and I am getting really frustrated.

I WOULD APPRECIATE ANY HELP, ADVICE, SUPPORT.

I've been in the same boat since Dec 2004.

Yes, it seems to be within the reasonable limits... for a case that involved both RFE and NC, that's it.

Thanks for your response basselal. I thought it would make me feel better knowing other people are in the same boat, but it didnt. This is ridiculous. I am contemplating suing them, but I havent found a lawyer yet willing to do it. I was planning on going to my home country for vacation, but I see the travel doc application fee is now over $300! If that is not exploitation...then I dont know what is...this is on top of having to apply for a new EAD every year...no wonder they're taking their time. The longer we stay in this status the more money they make....if we were really security threats you would have figured they would have more urgency in their processing.

Not to side with USCIS, but the bottom line is, you are seeking a benefit, you are not entitled to anything. If the cost and wait times are not to your liking, you can leave the US. There is no exit control.

How long did you have to wait? I am not trying argue with you, but I find it difficult to believe that most people would have this much patience...at least not with a fair amount of frustration. My point is what happens if one is just at the short end of horrible treament...and you may actually never receive service/GC unless you speak up. I just noticed another blog of someone whose case was in fact going nowhere and he decided to file suit...and WON!!! See the link below:

Madiba,
You missed the point I was trying to make. I went through immigration/citizenship twice in the last 10 years in two different countries. At every stage in both processes, I knew what I am seeking is a benefit. If I get it, lucky me. If not, I have no right to complain about something to which I have no birthright. If you want to sue USCIS, please proceed. I wish your case a speedy and favourable resolution.

I really understand your point. This is a FAVOR, especially in my case who slightly overstayed thus did not follow the US rules and laws. I think like you that this is something the USA is GIVING me.

But on the other hand I have never been stuck (yet) in name check and I can understand her frustration after all this time.

Apparently not....since its a benefit...you will have to just accept being treated like a piece of you know what. It doesnt matter if you wait 20 years...you have to be thankful for this benefit.

Triple is too "beggarish"

I think Triple is misguided or too much of a beggar. Due process of the law doesn't mean someone has to put a plunger in your ass, and tell you to wait because USCIS is still looking for a proctologist to fix your butt..:( Absolutely not!!!!

The FBI has a responsibility to conduct background check and report back to USCSI to finalize your case. However, if the FBI is still checking you for over a year, then make an info pass and request that the Director of the DO contact FBI and request a resolution to your matter, not send them a thank you not card... You pay for the service which USCIS provides, so by inquiring on what is going on about your applications doesn't make you an ungrateful spoilt little weasel:confused:, but a responsible citizen demanding accountability and response from a govt bureaucracy.

You need to write letters each month to USCIS and request them to adjudicate your case... Triple might be sincere, but he is clearly misguided and his counsel shouldn't be followed in this instance...:p
