I think this shows that I will receive my EAD pretty soon. I believe that having already a social helped a little bit. Thanks everyone for their help. EAD was the most important one for me since I am not rushing for the interview. Actually I prefer the interview to happen after our second anniversary so we do not have to deal with I-751. By the way there is a LUD on I-131 on 11/01/2007 as well. But it does not tell if they shipped it or not.

When is your second anniversary? I'm in the same situation where I'm almost ready to file (still waiting for the dr to finsh my medical exam reports) and I'm debating on when to file.

My 2nd anniversary is in 5 months from now, so I was debating on whether I should gather everything and wait another month before sending it in. I'm already working so I don't need the EAD until next July, although the AP sure would be nice to have earlier, but I'd rather have my interview after my 2nd anniversary than a week or two before it!

TNguy78, what status are you currently in and why would you need AP earlier? Can you complete your travel before you file for AOS? Visa stamp issue?

I'm on a TN. I got it in July and we have now decided to remain here in the US instead of going to Canada (I'm Canadian and my spouse is US). And now that we have decided to remain here, it would be wrong for me to attempt to cross the border and re-enter under a TN. When I first got it - it was a temporary job and we were still deciding where we wanted to reside permanently. But now it looks like it's a long term thing.

That's why it's truly taken 19 months after marrying a USC to decide to do my GC - we knew one of us would have to do permanent residency, we just hadn't decided in which country until now.

Mine is 9 months away. I think I will get the interview before that date.

Understood! From what I gather, TN is similar to H-1B for Canadians, however, not dual intent like H-1B therefore cannot be used for re-entry after having declared immigrant intent; and it's valid for a year therefore you're good thru July without EAD however would like AP to travel.

If you re-enter on AP, can you continue to work in TN status? Sorry for the probably obvious questions but I'm not very familiar with TN.

You are right about the TN not allowing the dual intent - thus I would like the AP. But if I use the AP, I would also like the EAD just to make sure that I don't need the TN (not sure if using the AP nullifies my TN or not and don't really want to find out either).

The way things look, people seem to get their EAD before their AP anyway, and I wouldn't use my AP without an EAD - just to be on the safe side. I'm just not in a hurry for the EAD like other people because I'm already working.

And since I'm only 5 months away from my 2 year anniversary I'm trying to gauge when to submit my application. I will probably submit it in about a month and if by some miracle I get my interview prior to my anniversary and it's within a couple of weeks, I will ask the IO to delay the approval until after it - I read somewhere here that and IO did that and simply asked them to send in a document, then he approved them and it was after their 2 year anniversary. No guarantee I know, but I'll just take it as it comes.

TNguy78, we were in a similar situation that we wanted to "time" our interview date because we had preexisting travel plans ~ 3 1/2 months after we filed yet didn't want to risk having our filing fees increased dramatically, therefore filed early (soon after the 60 day public comment period about the filing fee increase).

In any case, "luckily" we got an RFE which dragged out the process just long enough because I sent the reply about a week before our vacation. I received the EAD only a few weeks after sending the RFE reply so EAD wasn't delayed much, but interview date was nicely delayed. (Technically it re-sets the 90-day requirement for EAD, though.)

By the way in the status page it says that I131 is approved and they sent a notice. Is that notice the advanced parole itself? Thanks.
