is my brother included in the petition for parents?

Hi all,

1) I was wondering if my 19 year old brother can be included in the immigration petition for my parents? Or, do I have to file a separate form I-130 for him?

2) Another question is, once my I-130 is approved, what other forms do I need to send? Do I get a detailed instructions from USCIS about the forms and documentation that I need to submit? Could someone give me an idea about the forms and documents needed after an I-130 is approved so that I can start to collect them all in one place?

3) Can I file I-864 (affidavit of support) at the same time that I file I-130?

You must file a separate form for each eligible relative.

If your parents are here in the US, they could apply for AOS along with your I-130. Else, you will have to apply for I-130 and they should go for consular processing with your approved I-130.

You file I-864 only when you file I-485

and no, your brother cannot be included in your parents' application. You can file an application for him, and your parents can file an application for him as well upon becoming LPRs.
 
Thanks for your message ari4u. I heard that I-485 is only filed if the parents are in the US. But, my parents are not in the US. Do I still need to file an I-485?

Another thing which bothers me is that would USCIS actually tell me the next steps and would they actually send me all the forms in mail if my I-130 is approved? Or, would I have to research on my own as to what forms are needed, download them and follow up on everything myself?

Hi LucyMO. Thanks for clearing up my confusion. So, any ideas as to how long it would take if my parents become US citizens and then sponsor their son (my brother). I heard that parents filing for their sons is faster than a sister filing for brother.

You cant file I-485 as your parents are not here in the US. Your I-130 approval letter would tell you what needs to be done. It always helps to do your own research so you are well prepared.

I also wanted to know if it is allowed for me to leave the US for an extended period such as a year after filing I-130? If I-130 is approved, is it possible to complete further process while remaining outside of the US?
 
in order to file for your parents, you need to show that you are domiciled in the US. You will also need to sign an affidavit of support, showing income. If you are showing foreign income -- well, I just don't know how consul will like that.

It is slightly faster for your brother to get his GC through his parents parents, but it will take about 5-6 years before they will become citizens, then (depending on whether he is married or not, and his age) it will take several more years.

Your brother may want to play the DV lottery, if he was born in an eligible country, there is still time, I think.
 
Any ideas how long it would take on average if my parents applied for my brothers

a) as LPR's
b) as citizens?
