Is it wise to switch from H1 to EAD (IEAD)?

Hello there

I am working with H1 in a lousy company with insignificant paycheck.

Applied I485, EAD and AP with my wife (she is the primary applicant) November last year. (Haven't got the approvals of EAD and AP, thinking of getting an IEAD)

Planning to change a job with my EAD (since getting someone sponsors H1 is quite hard right now)

Please advice

I know I can work with IEAD, while can I change employers when on IEAD? Is there a limitation for changing employers when on IEAD?
I am working on pc hardware industry, can I change to other fields?
Or it is just not wise to switch from H1 to EAD?

You can switch companies, because 485 Primary is your wife not you. You can use your EAD as Green Card. If you are not the primary applicant.

If you think you have more H1 period, if some one files your H1 also good, because you can stay more period, in case some thing happens to your wifes AOS(485) you can continue with your H1.

You have 2 options, you can deside what you want...

Your wife is on H1, you are on H4?
If you are on H4, how can you work?
If you both are H1 and your wife is primery applicant and you have IEAD on her application, By God, you can do any thing legal under the law.

Take 10 jobs, work at any company.

Keep in mind, Primery applicant has to maintain relation with the old company, similar job, and other Blahs.

you are right. I am with H1 too.

I guess I was too silly and lazy not to look for another better job.

Planning to go to get IEAD and start actively on job hunting.

just a quick question.

If I use IEAD to work, I will be in the same case as I am an H4. Since H1 spouse (H4 holder) can work with EAD, rihgt?

Yes, You will be very much, as if you were an H4 and got an IEAD on that H4/ H1 from the primary applicant (your wife in this case).

In this case she will have to make sure that her H1/ 485 keeps going withpout any problem. You will file IEAD/ EAD/ EAD renewal/ AP etc exactly like and old H4 case. By the way, your existing H1 validity (if present employer does not screw up) will also continue.

Another route you may think about: You can also ask your company to sponsor another green card if you are on H1. Just in case her AOS has problem, you both are still safe. I know several couples did that a couple years ago. You know, it was very easy to find H-1 jobs back then.

You are a free bird since you have a derivative status to your wife's I485 application. Her employment and status is what keeps you both going. Regarding legal immigration status, once you have filed for I485 you are also in "AOS" status in addition to your H1-B. Since you are not the primary applicant you can accept any job even unrelated to your current occupation using EAD. Good luck!
