Is it under EB2 ?

Hi,

In my LC....

column 14 of LC (college degree required (specify))....
Master's degree or equalent *

column 15 of LC (other special requirements).....
*Employer will accept a bachelor's degree with atleast five years of progressive experience...
Must be willing to relocate, if necessary


Now, I had only 4 yrs engineering(BS)+ one year diploma+6 years of experience...my employer filed in EB2.....

Is it valid under EB2 ? (I don't have Masters).....

Yes its valid ... INS will only try to see whether 5 yrs out of your 6 was progressive experience or not . Now how they calculate progressive is entirely up to them .....

You need not have masters to qualify for EB2 , bachelor's degree with atleast five years of progressive experience also qualify for EB2 category ..

since in your case both the requirement and your qualification has a bachelor and 5 yrs of experience your case qualifies for EB2 .

But say if the requirement was bachelor's degree with 3 yrs of experience and even though you had bach+ 5yr that way it would have been EB3 .

So you are all set for EB2 ... rest is all up to INS ....Good luck

since in column 15 of LC it has been mentioned ....bachelor's degree with atleast five years of progressive experience it will be considered as the requirement ....hence EB2

They consider the minimum qualification (column 14 , column 15)

Say for example if it was Masters of equivalent in Column 14 and ....bachelor's degree with atleast 3 years in column 15 then no matter what your qualification is it would have considered EB3 but in your case both in column 14 and column 15 condition is for EB2 category .

I'm saying this because my case was initiall filed for EB2 .LC col 14 -Masters or equivalent and LC col 15 -bachelor + 3 yrs and my qualification master they rejected it saying since the min requirement for this post is bach +3 its EB3 case and please refile it in EB3 category so we again refiled the case in EB3 category and got 140 approved .

If either one is (either column 14 or col 15) satisfying then it should be fine under EB2 category (Thats what I understood)...Please let me know if this is wrong.

Anyhow I got approved 140 a month back, but after seeing many cases here what will happen once they verify in 485 stage. Do you have any idea that re checking these things in 485 stage ?
