is it true???

... that only the adjudication officer working the N400 file has updates on whether the name check has cleared or not??

This is what I was told by the immigration officer over the phone. Apparently if you move from one service center to another after the N400 is filed USCIS dosen't do any thing for 6 months till the file is re-assigned to a new adjudication officer.

any ideas - suggestions?

Actually, clerks in records check for name check completions and update the file and send it to the adjuducation officer

Not true at all. The truth is most officers who work on desk with computer can see this info by checking it up into the system.

As for the info given by USCIS over the phone, then never ever fully trust them. Why? Because the first ones are contractors who don't have any access to USCIS system. And the second ones (so called "Immigration officers") don't even speak good/correct English. Yes, they can see some information in their system but not all because in order to get other info on an applicant, a person must be working for clerking/processing unit with USCIS because clerical units have access to other screens in USCIS system.

It seems to me that your case is now struck in Name check nonsense. Good Luck.

Johnny Cash please give me an advise

I am waiting my IL since 5+ weeks but did not received yet. Some of my friends received in 3 and 4 weeks. I just called USCIS and IO told me I am waiting for namecheck only. Do you think it is a long delay or I should give some more time before act?

Please give some advise.

That is complete BS. Any immigration officer has access to this information.

You really can't control this. I don't know what you mean by, "...before act". But if you mean before you take any action, any such action will be totally futile unless your priority date is outside of the normal processing window and your name check has been successfully completed.

That's what I thought too. It's pretty amusing to see every Immigration Officers take on the matter. Why can't USCIS hire people that will share the same consistent information over and over again?

Thanks :). So besides waiting for the stupid name check to come back what other options do I have? get the senators involved?
Yeah, I would like to know that too. There is a lot of information on what you can do after your interview, but what if your fingerprints are done and you never get called for an interview. It's been almost a year for my dad since his fingerprints and he never got a call for interview.

You may contact Congressperson if you like, but FBI is not obligated to respond to Congresspersons' request. Plus, there is no LEGAL resource available to get out of this mess, unfortunately. I'm sure you have read hundreds of postings over this board wherein people have said very proudly that they have sued "bastard"+"incompetent"+"bureacratic" USCIS, but they were able to do so because laws allow to sue the USCIS if USCIS fails to make a decision within 120 days of conducting an interview. But in a siutation like yours, there is nothing anyone can do because there is no law comes in the picture when interview has not even conducted. I know some people waited/are waiting for years.

Nevertheless, that doesn't mean you cannot try your best. Rahul was in a same situation like yours but he took the matter in his hand than depending on some miracles to be happened. Thus, you can also try. If I were you, I would start writing/contacting to FBI, White House, and other "mighty" people, including congresspersons. Although FBI is not obligated to entertain a request from Congresspersons to expedite the name check clearance, but a request from Congresspersons might get their attention. USCIS has nothing to do with this mess. So, contacting them for this purpose would be a waste of time/energy, in my opinion. I think you shouldn't just wait; rather write to FBI and other people.

Good luck....

Yes, I mean "before take any action..." Also, do you think 5+ is a long delay to receive IL or it is OK to wait for 2-3 weeks more?

Thanks for your advise. I have contacted my senators office regarding this issue. Regarding the FBI I was able to confirm that my FP results were sent back the same day but was told that fbi no longer gives info on the name check. I guess I will email the vice president and first ladys office soon asking them for help with this issue.

this is just plain frustrating.

If I were you, I would just call the National Service Center's 800 number. But as I said before, if your priority date is not outside of the processing time published by USCIS for your respective DO, the call will not be very useful. However, the moment, your case gets outside of the normal processing window, escalations through the National Service Centers is extremely effective.

Regarding 5+ weeks wait, if you are getting impatient in 5 weeks after completing FP, you are living in a completely unrealistic world. Typically people have to wait for months from the date FP completed before get the interview letter. Yes, there are exceptions that get the interview letters significantly quicker. But that is truly an exception and not a norm.

Well there is a minimum of 3 month (90 day) delay while you wait to become officially resident in the new district, then anything beyond that is probably the result of your file being mis-routed or ending up in a black-hole somewhere.

Generally everyone should be encouraged to do anything possible to avoid moving districts or rescheduling appointments as such action will probably result in their case dropping off the fast-track.

I'm sorry, but your priority date is only about 2 months ago. That's a blink of an eye in USCIS-time. I'm not kidding - when someone has some delay happen, my normal advice is to wait 4-6 weeks for the USCIS to realize something has happened before doing anything at all.

In our DO, a six month wait is typical for PD to Interview (if everything goes well). Your application may very well be speeding through the process.

You need to re-adjust your expectations. Savour the wait - it makes the oath taste better :)

Good luck.

Sachin, I just noticed that you moved from CA to WA. That means, you have to give at least 2 more months more before doing anything about yr case. Because moving while a case is processing delays the processing. Besides, Seatle DO is notoriously known for slow processing in most cases. I'm sure you will hear from USCIS within 6-8 weeks unless you are in name check jargon....

I moved to Seattle in Nov 06 and filed a change of address right after. Do I still have to wait 2 more months? I believe I have met all the state residency requirements now.

No, you don't need to wait to prove an establishment of residency in your state because you already filed the application before moving to this new place. Establishing a residency in a state comes in the picture only BEFOR filing N-400.

And since you have moved to this new location more than 6 months ago, then you can now start being proactive. Good luck.
