Is it too late to change to CP?

I just recieved a letter from the KCC saying that they recieved my forms and acknowledge my decision to do AoS.

When I sent all the form about a month and a half ago, I said in the DSP-122 form that I wanted to do AoS. Two weeks later, I changed my mind and decided to do CP instead. I contacted KCC through the phone and they said that I need to send a new DSP-122 form with the updated information. I did that.

Even after sending the new DSP-122 form, I still got the letter about AoS from KCC. Does this mean I can only proceed with AoS and is too late to change to CP?

Does anyone know or experienced something like this?

Just finished talking to the person over at KCC through the phone. She said that my record hasn't been updated yet. It takes 6-8 weeks to get updated. She also told me to contact KCC in another 3 weeks, and if they still haven't update it, I should fax the new DSP-122 instead. She also added that I can change to CP at anytime.

What a relieve...

I am in the same situation, I did not know you have to let KCC know that you will file AOS. I jumped the gun and already filed for AOS, which is probably way too early, but I just did not know and the director of our University's international office did no know either.

Shall I send the forms to KCC now that I have filed with USCIS?

Yea, forget about the forms you sent to Chicago and continue the due process as if nothing has happened. Send the forms to KCC and let them know you want to do AOS and after that has been accepted pay the 350 (i can't quite remember) to DOS and wait till it's published that your number is going to be current before you proceed further. If you are lucky and your medicals is still less than 1 yr old when you are filing the AOS next year, there would be no need to pay and do the medicals again. Best of luck.

I'm not quite sure what you mean. Are you saying that you told KCC that you want to do CP but you sent the forms and documents to USCIS for AOS?

As far as I know, regardless of your choice, you need to inform KCC about your choice (CP or AOS), and if you make any changes of these choices anytime before your CN become current, you need to inform the KCC also by sending them a new updated DSP-122 .

First of all, thank you for taking the trouble. No I did not know I had to send anything to KCC. I send them the DSP-122 today with 2 photos as the lady from KCC told me. I completely jumped the gun on the USCIS Chicago lockbox where I sent the whole package on AOS with I485 etc.

you took care of the KCC part, they will update their records showing you are doing AOS. And you also realize you did AOS procedure too soon, you might get luck(very unlikely) and they process your application. But most likely they will return your package saying your nunber is not current yet, but cash in your processing fee check anyways, so that's unfortunate. Just re-do the process couple months before your number becomes current.
