We just received teh notice that informs us that our petition for NIW is approved. But we quitted our jobs in US and left there several months ago and right now we are working in our own country. Is it still possible for us to get the green cards?

I am not sure but when you file I-485 you can ask for CP councellar processing!

NIW while outside US

NIWyer, It is possible to get Green Card from outside US. I applied I140 in Nov 2003. Left US in June 2004. Got RFE in May 2005, answered and got approval in Aug 2005. Have not applied I485 yet.

My question: If I go back with O-visa (H1 quota filled, so... going with similar job profile as NIW application) and file I485 (when Nov 2003 becomes current) will that be ok? Gurus pls answer...

I think you may get through CP. You may need an offer letter to support that you will be working in the same area for which NIW was approved.

I think our I485 has been approved since we filed I140 and I485 concurrently.

Probably not. See all people around here waiting on their I485 after I140 approval.

Why? It is written on the notice that 'the petition is approved', you think it is means I140 is approved, not I485? So what means concurrently filing?

Which country r u from .....retrogressed or not retrogressed?
what is your PD/RD?
What is the exact message on approval notice?
did you guys get separate approval messages for your primary and beneficiary/derivative I-485 approval?
Did you ask for councellar processing or AOS in US?
If you got approval while not in country u will have difficulty ahead?
are you travelling with Advance Parole?
concurrent filling is fine but concurrent approvals are rare?
In the end...you need to browse little more on internet to get idea of all these processing!!!!!

I-140 and I-485 got separate waiting lines, and separate approval notices. Check more accurately the message on your notice. Concurrent filing means you filled them concurrently.

Good questions! I know we have difficulty ahead, that's why I am here.
I really did homework for the questions.
I am from a retrogressed country.
PD is Nov 2004. No RD because the notice is from the appealing office. There is LUD 2/8/06 for I140, but not I485, so I think only 140 is approved.
We did not use AP, we just left US.

The reason why I asked this question is because if you are from retrogressed country and PD is NOV 2004 then you are not current yet (if INDIA u will get current most likely next month buletin APril 2006, if china wait is probbaly 3-4 months for thsi date) ....so chances that I485 got approved is closed. SInce you didn't use AP you actually didn't take permission to travel out so you need to check on procedure of converting your AOS (adjustment of status) to CP.....I am not sure how u can do that ...but little bit research can help!!

NIW is under EB2 and so it is probably not going to be current next month.
