Is it safe to use EAD in my situation?

I am currently working as a research scientist in a university, and in just a couple of weeks I will join another univ. as a tenure-track assistant professor in the same field. Since I used AP this summer, the lawyer in the new univ. was not sure if a H1b transfer would be accepted by USCIS. So she filed a new H1b petition to Nebraska center and the RD is 9/22/04. BTW, I have got my second EAD already.

I may use EAD to join the new school, if my H1b application is still pending by then. But I will lose H1 status once I use EAD. Is it safe to do that? What if the H1b is approved later, after I have used EAD?

Is it safe to do that?
-if your I-140 is approved then it is safe but if any problem with I-485 it is safe to be on H1 status. if your lawyer filed H1 transfer with recent pay stubs then with H1 transfer filing reciept you can join new employer just make sure with lawyer that he filed H1 transfer and asked I-94 to be extended ( becase many lawyer file it as NEW Fresh H1)
What if the H1b is approved later, after I have used EAD?
----- go out of US, get H1 Visa stamp based on H1 approval notice and enter on H1 status and you will get I-94 based on H1
