Hello Guys,

I worked for 2 years in NY on J-1 visa (no 2 -year rule) and recently had my H-1B application approved. Can anybody say definitely is it possible to get my NEW H-1B visa stamp in Canadian consulate?
If I visit Canada BEFORE the expiration of my J-1 visa (which will expire in a month, in case of denial to stamp my H-1B can I reenter the US with previous J-1?

Thanks in advance.

There are no guarantees in life, same holds for H visa approvals in Canada.

Unless your qualifying degree is from US, getting a H1 stamp in canada (especially toronto) is a risk.

And if your H1 is refused , per April 2002 memo you need another non immigrant visa with valid I94 , which you seem to have, to enter USA again.

Thanks a lot! If I get you right, the H1 refusal DOES NOT mean the automatic cancellation of previous J-1 visa. Am I right?
