1. A girl came to the States in 2000. No visa (through Mexico). No petition filled for her ever. Now she wants to marry a guy who is under 245(i) - he just got his labor certification for Department of Labor (petition filled in February 2001).

If she marries him is it possible for her to adjust her status here (get a GC)?

Will she be added to the petition and have opportunity to be covered by 245 (i)?

2. And a very similar situation but the girl came to the USA in 2004 (no visa etc.) Any chance for her if she marries the above guy?

Any suggestions/comments? Please help. :confused:
 
The girl #1 was at the lawyer's office - he said she would get a GC if she was able to prove that she had been in the US in December 2000. He said the husband's petition would cover her because he did not have any interview in the USCIS so she could be added to the petition. So she is a little bit confused because she doesn not want to do anything that can cost her a deportation notice.

PS. There are 2 different guys, 2 different situations, just wondered what was possible to do in their situations...
