Is it possible to use your own previous labor certification?

Hello Gurus,


Following is my case :

My labor certification was filed with Company A with a priority date of June 2001 in Massachusetts. (MA , NON-RIR).

I left the company (A) in April 2003 anticipating a lay off and joined company B.

The lay off never happened and even though the company was acquired by some other company, my colleagues were able to continue their green card process successfully.(also some of them recently got their labor certifications.)

Now, I have joined the company A again. My question is :

Is it possible for me to use the my previous labor certification?

If the company/lawyer disagrees to do so, is it possible to use the priority date of my previous labor certification(June 2001) and start the labor certification process afresh(MA , NON-RIR)


Any other comments/suggestions are welcome.

YES provided that labor is still available and not used for someone else.

YES provided you filed i140 based on that labor and has been approved. in this case you can use that priority date in the same company or any other company you join
