Is it possible for my previous empolyer to revoke my 140 while my 485 is pending after changing job? I know this was one of hot topics in the past but still not sure.
I am thinking changing job using AC21 before 485 is approved. Thanks,

They can't do you any harm after 180 days have passed since I-485 ND. But, make sure you don't forget to file your AC-21.

The rule is there but your previous employer can still withdraw I-140. It should not affect your pending I-485 if it has been pending for more than 180 days. BUT be ready with all the AC-21 papers as my case was denied by some stupid INS officer. I guess that the officer did not know of the new memo, I hv to file for MOTIC to reopen it.

joondad,

If you ever suspect that your i485 might be revoked for any reason, I'd like to advise you not to change jobs. My case was also denied due to the revoked I-140 as urguest's. I had to go out the states to get a new H1 visa, too. I filed a motion(MOTIC) and it was approved more than a year after it was filed with Congresswoman Anna Eshoo's help. Then, RFE, 2nd FP, and more waiting. Better not get into unnecessary troubles.
