Is it possible to get spouse a H4 visa whilst I am a H1B holder & got I485 approved?

Dear All,

I am currently a valid H-1B holder and very recently (last week actually!) I got my I-485 approved through employment based application. I am intending to marry my girl friend overseas to bring her over to join me. Previously I was planning to bring her over to USA on H4 visa... but the approval of I-485 disrupted my original plan :rolleyes: ! My question is: Is it possible for her to get a H4 visa given the fact that I have already got my I-485 approval. Can I still maintain my valid H-1B status so that she would come on H4?

---------NO, she can get H4 if she gets married to person who is on H1 status. you lost the H1 status they day your I-485 got approved

Lithium, i hope you got married b4 I-485 approval?? Impacts how much time it will take for spouse to joing you. Marriage after 485 could mean significant wait time.

People have been known to surrender their GC to unite with their significant others. You'll have to chose 2 out of the following 3:

1. GC
2. GF
3. Living in USA

Thank you guys for all your contributions! I am much grateful :)

It seems that the overwhelming responses I got so far are quite negative - my spouse has NO way to get H4 once I got my I-485 approval :(

I am wondering if there is a way to revoke my APPROVED I-485 and still maintain an approved I-140 and possibly refile a new I-485 later ? Is it a mission impossible? have somebody out there done the impossible ?

The idea is that I would like to maintain my H-1B status, and bring my spouse over on H4.

P.S.
My I-140/I-485 were concurrently filed in VSC in September 2005 based on Eb-1 (Outstanding Researcher). I got I-140 approved in April 2006, then I-485 approved in August 2006.

The PD of I-485 in VSC is CURRENT for my nationality.
