Is it possible for my Home based Company to hire employees by doing H1-B Transfers ?

Hi JoeF/Gurus,

I am planning to start a Home based Software Consulting LLC using my EAD status. (I heard from this forum that I can't start S Corp with my EAD)

My employees are software consultants and they work at different client places, so I don't need a separate office to manage this business, thats why I would like to use my home as office.

1)I have few H1-B friends who are willing to transfer their H1-Bs to my company. Are there going to be any issues from INS in H1-B transfer because of my company is Home based ?

I have another question which is not related to the H1-B transfer.

2)Does my company require to take General Liability , Professional Liability etc.. insurances if I do just corp-to-corp consulting business without hiring employees directly ? (My company will act as just middleman company between consultant's employer and client's vendar)

I appreciate your responses.

Thanks in Advance,

SoftConsBizGuy.

Hi JoeF,

Thank you very much for your response. I think I mixed two different questions in one topic. Let me explain them separatly. Please take a look at it and give me your valuable answers.

My fisrt question is : For intial one year I don't want to hire any employees at all, all I want to do is corp-to-corp consulting. Consultant's employer company will be having all those liability insurances. In this case does my company still need to have those liability insurances ?

After initial one year I will definitly take all those liability insurances as I would like to hire employees at that time by doing H1-B transfers.

The city where I live, there are so many home based software consulting comapnies, so i don't think city has any issues starting a comapny.

My second question is : Is there any chance of H1-B transfer getting denied or any other complications from INS just because of my company is home based ?

I appreciate your respone.

Thanks,
SoftConsBizGuy
