i joined a software company in MARCH 2000 on OPT after finishing my MS. That company applied for H1 visa in JULY 2000 which was approved on SEPTEMBER 5th 2000 with start date as OCTOBER 1st 2000.
But i was laid off on SEPTEMBER 8th 2000. and i did not even knew that my H1 visa was approved since the company told me at the time of layoff, that they are cancelling the H1 process ( but why it was approved,god knows????/)
Anyways,i still had my OPT until JANUARY 2nd 2001,so i joined another company in NOVEMBER 2000. They failed to Apply for an H1 visa before the end of my OPT (their lawyer was very lazy).so i stopped working on the last day of my OPT.
Now,things took a wrong turn and i found out that my H1 visa with the previous company was not cancelled but in fact was approved on SEPTEMBER 5th,2000 with the start date of OCTBER 1st 2000. Luckily, i had paystubs until OCTOBER 15th, 2000 ( severence pay), and with those i applied for a transfer on JANUARY 27th, 2001. My H1 visa transfer was approved in MARCH,2001 with a new I-94 and rest is history.
Even after 2 years,i still have nightmares about that.was i out of status?. If so,can i never get green card?. I still dont have a H1 visa stamped in my passport. will i be rejected if i go to mexico/canada?.
What exactly happened to my status?.can anyone of you immigration gurus tell me, please.......
