My husband is a physician who is doing a J1 waiver in an underserved area. He has worked in this place for 5 years. His Labor is approved and he is adjusting his status after applying for I-485 in 2003. He has an EAD card and also has a valid H1B visa and he is in the 5th year of H1B. The priority date for his I 140 is feb 2002 and he is on EB2 category. This is my question. He wants to move to another town to do his fellowship using his H1B visa this July. Is it ok to leave before the green card gets approved? I have read that he could leave 6 months after applying for 485 if it is the same kind of job. Since this is a fellowship, would the same rule apply. Please give me some suggestions as to what we could do because hubby wants to leave the small town as soon as possible to pursue the fellowship.
