Is it legal to be denied of EAC# for I-1485?

Hi,
    My company lawyer said she has received the receipt notices for my I-1485,EAD and AP applications, but would not be sending me a copy, for its against the company policy.Is this legal for them to withhold my information ? I havent the faintest idea why they would be doing such a thing ?

I don\'t think your company has the rights to hold on 485, ap and ead information. Unlike I140 which company sponsed, you are supposed to be the applicants for 485, ap and ead. This is my own opinion.

Great Mess. You are the one should hold all these information, since you are the one to answer to law if you are caught while reentry. What proof you are going to show that your case is pending, having valid work status etc.? Your company and the lawyers do know all these information but mentally sore. Try to get the documents by telling them these reasons.

In I-485 processing, you are the applicant. You must have signed sevaral forms to say you are authorizing your company attorney to handle your paperwork. And also if you are paying the fee for the application and attorney, you have a moral and legal right to ask for the receipt numbers. Also, by hiding your EAC numbers your company can not slow down the processing. Couple of reasons I think they are hiding it are:
- They applied later than when they were supposed to. They do not want you to know that.
- They have not yet applied, and they do not want you to bother them.
- They have messed up your paper work and want time to fix it.
Talk to your employer and ask for the receipt. Or wait till you get the EAD card and then using your A#, your can call INS and get EAC numbers.

better yet, you can technically file a report with INS that they are withholding information and if you tell your stupid lawyers (sorry) that should knock some common sense in their heads. What ever your lawyer is dealing on behalf of INS is really as a service to you and hence is the reason they get paid. When it comes to legality INS knows nobody except you and in the case of employment verification only is when your company comes into picture. Whether your company pays for immigration or not, you still have a right for ORIGINALS notices/approvals etc(not copies) becuase INS sends two copies, one for petitioner and one for the BENEFICIARY (which is you).

Jacob, here is why.. I had the same situation.

Basically, INS do not want you calling them about the status.
If you have the receipt number you can, otherwise you won\'t
be able to talk to IIO without these information.

My lawyer told me that INS cautioned them not to give out the number.
I think INS does this to everyone who is represented by a lawyer.

What my lawyer told me was he will call for status on my behalf.
He told me that they call regulary about the status of his clients
and ask INS all together. So he said that is the reason why
I do not need this number. Of course after screaming and
yelling (not necessary) I convinced him to give me the numbers.
I basically, told him I will be checking thru automated message system.

Well, bottom line is you should be able to get it.

Question? Do you think your lawyer blames INS just not to give the information to you. Since if your lawyer told you what INS told and asked you not to call INS but still gave you the copies, then may be they were right.

Well, I am not triggering anything. These are just my personal thoughts, since I don\'t know your lawyer and you know them better.

You can get them if you tell your lawyer that you are planing to visit your home country. My lawyer did not give me the information when my 485 filed. I was told that some of his clients called INS themselves and screwed up their cases. I am not sure. However, I got those info anyway when I did my fp because they have to give you fp notice which have all information. Personally, I do not think I need them (ND, EAD) until the fp done, if your fp notice does not come too late.

I managed to get mine from her.
