Hi,

We are about to apply for the green card... I knew about the premium process a month ago.. And so did my wife's coworker who filed for the green card two weeks ago. She paid the $1000 for the premium process but got the check returned. We hear that they dont do premium process anymore (temporarily?).

Is that right? I have been looking for info in different websites and havent found anything saying that. Please advice..

tnx.

As far as I know, premium processing is available for employment based GC, i.e. for I-140 filing. The only exception are: NIW and EB-1C Multinational Corporate Executive Petitions. I did not read anywhere that this is discontinued.

Are you talking about Employment based or Family based categories? for filing I-140 under EB-1a, b, EB-2 still PP is in place.

I am talking about Employment based GC. As far as I know, my wife's coworker is going to apply as special interest while my wife is going to apply as EB2 but the special case with teaching component. She has to go through the labor dept. process.. while her coworker does not (coworker is seeking GC through EB1, I infer), from what I remember.

If special interest is EB1, does it mean EB1 cannot apply using premium process?

PP is still in place for EB-1a (extraordinary ability) and EB-1b (outstanding researcher).
