Is I-131 really necessary for a spouse of a US citizen?

When I read ‘GREEN CARD THROUGH MARRIAGE Information and Application Guide 18TH EDITION (e-Book)’ provided by www.usimmigrationsupport.org, it mentions below, ‘The foreign spouse does not have to obtain an advance parole travel permit if Form I-485 is filed, accepted and pending with the USCIS’. What does it mean? What will happen if a spouse travels aboard during I-485 pending and reenter USA? I thought I-131 is always required to reenter USA before obtaining a greed card.

It is required for any person adjusting Status (I-485) who plans to leave the US for a period of time, to obtain an Advance Parole Document (I-131) otherwise, his petition for residency will be considered abandoned as soon as he leaves the country.

Unless, that person has a valid dual intent visa (such as H-1B).

And, if that person has accumulated over 180 days of illegal presence (or overstay) in the US then the person SHOULD NOT under any circumstance leave the US before receiving the Green Card. Whether he has Advance Parole or not, he will be subject to a Ban of 3 years (for over 180 days of overstay) or 10 years (for over 1 year of overstay).

That book you got (waste of money) is wrong. Demand your money back.

Northcloud,
This is how it breaks down:-

AOS applicant has no intentions of traveling = no I-131 needed
AOS applicant has a need to travel and has a valid H-1B or L-1A/B visa = no I-131 needed
AOS applicant has a need to travel = I-131 needed

When you say a valid H1B, do you mean a valid visa (in the passport) I have a H1B that is valid, but the H1Bvisa in the passport is expired.

Please clarify.
