Hello everyone,

Following is my situation:

BACKGROUND:
-Currently applying for I-458
-My wife and I have AP approved earlier this month. (recieved copy)
-I have my 7th year H1B extension approved but visa is not stamped on the passport yet. (My 2nd H1B visa has already expired in May.)
-Applied for my wife's H4 extension but not approved yet.

SITUATION:
I have to go to Japan due to emergency business trip probably on Friday.

QUESTION:
From what I have read in this forum, are following statements true?
1. I can re-enter USA with AP only (better to accompany the copy of I-485?). I do not have to get H1B stamped on my passport.
2. This is also true with my wife's case. She too can enter USA with AP only.
3. For precaution, I should bring the copy of approval notice of H1B extension.

Thank you in advance.

Guttchan.

Hello everyone,

Following is my situation:

BACKGROUND:
-Currently applying for I-458
--- You have applied I-485 that is the base of AP
-My wife and I have AP approved earlier this month. (recieved copy)
-I have my 7th year H1B extension approved but visa is not stamped on the passport
------------ You can use AP to renter or can get H1 visa stamped in your passport to re-enter US
yet. (My 2nd H1B visa has already expired in May.)
-Applied for my wife's H4 extension but not approved yet.
----- Keep the H4 extension receipt copy with you if she gets H4 approval then she has valid H1 or can get H4 based on your H1 approval notice if she has also got AP she can enter by using AP, she has both the choices
SITUATION:
I have to go to Japan due to emergency business trip probably on Friday.

QUESTION:
From what I have read in this forum, are following statements true?
1. I can re-enter USA with AP only (better to accompany the copy of I-485?). I do not have to get H1B stamped on my passport.

----- If you want to re-enter on AP no need of H1B visa stamp in passport but if I have time I will get H1B visa stamped because again if you have to go out you will have valid visa in your passport as many service centers are taking 4-5 months time to approve AP, if any emergency visit in future H1B visa stamp is much better and you will also save time at POE if you have H1B visa stamped, if use AP then at POE they will take you to secondary inspection and wait of 20-30 minutes at POE after jet leg
2. This is also true with my wife's case. She too can enter USA with AP only.
--- she can use AP or can get H4 visa stamped based on your H1 approval( keep the H4 extension filing receipt, show only if asked)
3. For precaution, I should bring the copy of approval notice of H1B extension.
-- keep it with you, if want to use AP keep I-485 filing receipts with you, if want to get H1Visa stamped then take all the required documents with you.

Ginnu, thank you for your reply.

I will be flying to Japan today.
I hope everything will be fine at re-entry when I come back in 10 days.

Talk to you later.
