My wife is on a dependent H4 visa and has an I-485 pending. The H4 stamp has expired but she did receive the H4 extension. About 2 months back, she had to leave the country and travel to Brazil due to a medical emergency related to her parents. The plan was for her to get an H4 visa stamp to come back to US. A few weeks after she left, I got my green card, somewhat earlier than expected. Since I have a GC, my H1-B status goes away which means it may not be possible for my wife to get a H4 visa stamp. Also, a few days after I received my GC, I was impacted by the layoff. So, I no longer have any connection with the company which got me my H1B and her H4 prior to my GC.
I am trying to figure out how to get her back in US:
1. Is there any chance she can still get an H4 visa stamp even though I am a Permanent Resident now and no longer with the company that filed my H1B and her H4?
2. Can I apply for an AP on the basis of the pending I-485 for her and can she re-enter US using her AP even though she didn't have her AP before leaving US?
3. Are there any other options available to get her back?
Would appreciate any advice and similar experiences.
