Is F1 (Student Visa) bad for AOS?

I'm an international student (F1 visa) and currently doing my OPT until April2008.
I'm doing my AOS right now, my number became available on Nov2007. So I'm guessing that I'll get my Green Card before April2008. (crossing fingers!)

I've heard that sometimes F1 visa holders are rejected in the AOS DV Lottery process. Do you know why?

What should I do to make sure I'm not rejected?

Thanks,

Lucky2008Winner.

really?

right here on our forum, an F-1 student didn't get her DV AOS approved in time...

SHe simply ran out of time.

Other F-1 people, just like anybody else, may get a rejection for a variety of reasons - starting with crimes in the past to a communicable disease to inability to prove that they will not become a pulblic charge. Do a search on the forum.

But the fact that she didn't get it was unrelated to her F1 status, delayed namechecks happen all the time, so the point remains, that there is nothing particular about the F1 status that means you will be turned down, but as Lucy says, there are plently of reasons for rejection, both AOS and CP.

I am here in F-1 status and i decided to go for CP and i have an interview in March. But I am in the real trouble.I don't know i will be able to return US using my F-1 visa if my GC interview is denied. Also i don't that i will be able to go for AOS as i had already mentioned CP in the form i had submitted to KCC.So if anyone know about this case please reply me immediately to lamsal_56@yahoo.com .Thanks

If your greencard is denied, your F1 will be canceled - the F1 is a non-immigrant visa, and by applying for an immigrant visa you have shown clear immigrant intent. So no, you will not be able to return. This is the main reason I did AOS (I was in F1) - but I am extremely risk averse. There are plenty of F1's who have done CP and have been fine. Just make sure you have all your paperwork in order (financials, enrolment letter etc).

Same here. So what kind of financial documents are needed?

Do you think a letter from the school is enough (I get stipend + tuition)? Are bank statements needed?

not that bad (sometimes)

I was on F1, I chose CP and I think it was the best decision I made. maybe I was lucky. but there are 2 things to think about before doing so.
1) you will need to gather some documents in your country including medicals, police reports, etc. so you need some time before the interview and add at least a week after your interview, so all in all it will take at least 15 days. that may not be feasible if you are taking many classes.
2) your country (or your name) may be one of those that require additional administrative processing (security checks) in that case it is impossible to predict how long it will take.

In my experience the financial info was not important. We were never asked for any...

in summary, if you have a GRA, your number is likely to be current in the summer, you are in good health, have an uncommon name and you are from a country that does not require extended security checks maybe cp is your best bet.

P.S. the benefits of cp increase if you have a high number.
