My friend is having to get his Marriage Certificate re-issued from India. For purposes of I-485 Filing, do they REQUIRE the Marriage Certificates to state the Date of Birth of Husband & Wife?

Of course he is submitting Birth Certificates also, but want to check with you guys ...

Thanks..

Marriage certificate has to be exactly the same as original, therefore if your original has no birth date, your translation won't have it either. You cannot ask the issuer to change that.

Thanks for your reply...ruxrux.

The new Marriage certificate is not a translation. It is already in english. He is having to get it re-issued for other reasons, but yes he could possibly request the issuer to write in the D.O.B. even though the Marriage certificate Format does not ask for it specifically.

My question is : Does the INS require the Marriage Cetificate to have the D.O.B. on it.?

If it is not on the Marriage certificate , does the INS then require an additional affidavit ?

That's a very intresting question and the best that I can tell you is you'll have to investigate in 2 places - first go to BCIS CSC 2003 guidelines (I'm sure you'll find a link to pdf doc somewhere in this discussion group) - if I remember correctly, there is a chapter on Marriage Certificates and other documents, but that may only have to do with translation instructions. Second thing to do - BCIS web site, search for marriage certificate and see if anything useful comes up.

Then, if it's easy enough to ask for D.O.B.s to be added, why not go that way?

your ID goes with your parent's name and DOB on your MC.. So if your MC does not have DOB then I would say it is incomplete. If your friend is getting new MC then probably it will have DOB also. I have not seen MC without DOBs.
