Is it safe to use others approved LC? Can it cause any problems in I-140 / I-485 stages?

I thnik if your skills are a perefect match for that pre-approved LC then it is safe. At the most you may get some query at 140/485 stage. For that matter nothing is safe as far as the Green Card proces is concerned. So evaluate your own situation and take a calculative risk.

What if the skill set partially matches? Can I-140 be rejected?

And if I-140 rejects, Can it cause any problems to my actual LC?

You should consult a good lawyer to evaluate the risks of your case if your skills match partially.

If 140 is rejected then that LC is of no use to you.
I do not know whether that can be resused for someone else.

Hi,

I understand that if 140 is rejected, then that LC is of no use. So that means the pre-approved LC which I used will be of no use. But what about my actual LC? which is in process for the last 3-1/2 years.

when considering a pre-approved labor is it always considered as a EB3 ? even though the labour was originally filed for EB2 ?

NO. It could be used for EB-2 if you qualify for it.

How Much Chance To Approve

If substitute labor was with java devolopment and the person who is going to substitute was with different field like ERP ,is it a problem to reject at I 140
stage?

Question about Pre-Approved labour rumor and requirement

Pre - approved labour:
I am getting pre - approved labour but there are lots of rumor heard that subustite labour can not be use any more from Sep 2005.

Is it correct or just rumor?

Is there any new progress for subustitute labour?

Pre-approved labour requirement :
the approved labour Job description is exactly matched with my area of experince and have enough number of experience.

In addition I have Bachelor degree in Science and also MCA degree with 10 years of experience.

In pre-approved ETA - 750 form of

line 14 says "master degree or equivalant" with 2 years exp.
and line 15 says "employer will accept bachelors degree with atleast 5 years of experience
My question is that whether I can use this subustitute labour while line 15 says "bachelor with 5 years of experience"


What else should I consider before use this substitute labour?
