Is applying for EAD/AP wise? - UnitedNations?

UnitedNations,

I just filed 140/485/EAD/AP/Substitution/VSC recently (RD 12/21/04) but now I have begun to doubt the wisdom of filing for EAD and AP. I suspect I may get RFEs or if my 140 or 485 gets refused, there is nothing to fall back on. But if I hadn't filed for EAD and AP and also filed for a fresh labor from NY, I could get 7th, 8th yr extensions on my H1 based on this new Labor.

But now that I have applied for EAD/AP does it make sense or do I even have the option? Btw, I am assuming that I will be issued EAD/AP because my ND should be before Jan 1 but I am not sure.

Any ideas?

Hi There,
I am sorry I don't answers to your questions...but I have a question of my own.

How did you come to know of your RD?

Did you get an acknowledgement or your checks were cashed?

My lawyer sent my packet to the INS on 1208/04...now news yet!

I am assuming RD means Receipt Date meaning the date they received my fedex package. My lawyer gave me the tracking number. It was shipped on 20th and some guy signed for it on 21st and it said delivered in Vermont. Of course ND which is Notice Date is what I dont know and won't know until I get some documents in the mail and/or an EAC number (VSC). This should be the date they officially acknowledged and filed my case. Let me know guys if I am wrong somewhere.

Btw, my original question is still unanswered ;)

Posession of an approved EAD/AP in no way impacts your ability to get a 7th year H1. They're good insurance.

I guess you didnt read my post carefully. Let me try to explain this better.

In case 140/485 gets refused, isnt it better to have a backup labor filed and be on H1 status so that you can fall back on 7th/8th yr extension??

Of course, if you are sure the case will get approved, EAD makes sense.
