IRS related Question

Hi,

This question is related to IRS.

I am on H1-B visa. Got married in April 05 & came along with my wife (H4 visa) and because of some issues my wife went back home on june 05.
Now my wife from india has filed monthly expense in matrimonial court and is not willing to come back to USA. Legally i am married but dont have any SSN or TIN for my wife.

Now my question is what will be my status while filing tax for 2005. Am i suppose to file single, married or married filing sepreately.

Anyone knows about it and reply will be highly appreciated.

Unless you have TIN number for your wife ( to get one your wife's current I 94 is required), you are single in US as far as IRS goes.
 
I think you can file 'Married'

Hi,

I think you can file married filing jointly option and at the time of filing you can request for her TIN number ( I think you need to send form 10 along with you taxes )

I have done like that only intially with my husband. He came here on h4 in 2004 and did not apply for TIN . So, in 2005 tax filing, I filed as 'married' and at that time filled up one form and sent aling with the returns. after 3 months, IRS issued TIN number for my husband...

so you can do the same, but you need her signature though.

But curious, why didnt you ask your tax consultant ? ( lol )

I have a different question related to TIN. My tax consultant told me that I can file my fedral tax and state tax along with the W7 form (TIN application form) and I dont have to wait for IRS to issue a TIN to my wife. The assignment of TIN and filing of returns will be transparent. Do you think this is OK ?
