Intra-comapany job transfer !

I work for a corporation "Z" which has several business locations within the same State I live in. My current job is located at SITE A.

I am in the Nebraska Service Center (NSC) area. My L.C. Application is currently with DOL and looking at the recent dates, it may be approved in February 2002. In NSC area I-140 is being approved roughly in 2 months. I will max. out 6 years-H1B in October, 2002, so there is not enough time to apply for new L.C.. My current LC application states that my job location is at SITE A. And all the business and the office at this SITE A are being sold to another company "X" within the next 6 months. But I will still work for the same corporation "Z" and will be transferred to another business location that is located 30 miles away, within the same State. My question is : Will my job transfer disturb any of my LC & GC application paper work ?

Is there anyone who had similar experiences ? Is there a rule that would give exception to such intra-company job transfers within some specified distance limitations.

This a very complex scenario and I would advise discussing it with a very competent immigration attorney. I suspect you\'ll have to start the LC over.
 
Solution may be simple, but depends on individual situtation . . .

What I found out is, if the employee is still going to work within the same MSA, i.e. Metropolitan Statistical Area, then it would not effect the LC. MSAs are defined and more details can be found out at http://www.census.gov .

Our company filed my LC from our Coporate Head Office (with corporation name), and I was assigned to this location (office) for working on this project, and because of this latest situation of selling off this Office, they wanted to assign me to a new project at another Office location and this location is within the same MSA. Do I need to be still concerned ?

Hi, bpr. Thanks for the info you posted. One question I have is \'are you going to be on the payroll of the new division?\' It could be quite differnt if you are.

I will be on the corporate payroll as always. Infact all the employees of the corporation all over the US are on the same payroll.

GC is for a future Job

Hi,

I thought GC is for future job and it does not matter where u work right now.
Am i right???
I am also working in State A but my Labor is filed in state B because my sponsor company is in state B.

Yes that is correct, if your labor Cert. is filed in state B and the sponsor company is in state B, that will be all right.
