Interview with Record

All,

I just joined and I have read quite a few scenarios that folks have gone through however, none seems to match mine. I have been a GC holder for 19 years. I recently applied for citizenship and have gone through the FP process and have an interview date in March (few weeks).

My concern here is back in 92, I got arrested (after a wreck) and charged/convicted for theft by receiving. Decal was a stolen decal....stupid!! Anyway, I have long since been discharged and the record was sealed as long as I did not do anything stupid and idiotic again. All this paper work was submitted with my N400 application and it seems there is no issue so far (not sure if this is just routine). As a matter of fact, the evidential docs I was asked to bring in looked similar to what i have seen on several threads:

1. Come with GC
2. Come with Passport
3. Come with Selective Service Information

......nothing about arrest stuff (I guess the submitted info sufficed).

My question here is, has anyone gone through anything similar or know of anyone who has? What was the outcome?

Considering mine has gone this far and for all intents and purposes...good, am I worring for nothing?

We are talking about immigration and I have heard of deportations for stuff done years ago.

BTW three yrs ago, I renewed by GC with this new information provided to them. Now it is possible the right hand does not know what the left had is doing. Anyway, any thoughts would be appreciated

Damn even your name check passed!!! Since 3 years back, you renewed your GC with all that info, there is a good chance that they will have that info... let's see if we find some with some experience on such issue... I think you will be alrite.

Yeah, there has been no issue....period. That is supposed to be good.....at the same time it is still very disconcerting because I have read and heard of people who have lived for years after one stuuuuupid/foolish mistake and without warning, after the interview, their lives are turned upside down....

Not sure if those were just the exception, exaggerated or simply the case of not telling the complete truth (as in other crimes may have been committed)....not the case with me.

....but yeah, i did pass the name check...with a date with what appears to be standard requests for documents I listed....btw, thanks for the response...

You shouldn't have any problem - the crime occurred long outside the 5yr CIMT window. You declared it and have proof of disposition, so there isn't much else to do except go attend the interview.

All,

My passport and selective service card have a middle name that is not on my Green Card. There is no reason except that I do not, never have used the name. My state issued license does not have the name....will that present an issue? I have had my GC for close to 20 yrs now....do you think much ado would be made about the name/initial?

I imagine that it would be simply corrected and added to the form.....thoughts??

What is on your birth certificate? That's the name they pay attention to, unless you have a court order indicating a change to a different name. As long as the name(s) on the N400 match what is on your birth certificate or court order, and your "other names used" (if any) are also listed on the N400, you should be OK.

Well....my BC has been lost forever and it is not a a United States BC.

My passport has all three names,
SSC card has all three names,
SSN has all three names (even though they did not ask for that),
Drivers license has two names and
GC has two names.

The key (unfortunately) is that the N400 did not have the middle name. I just thought that it could be left out. Now I am not sure if the omitted name would be a show stopper.

I realize this is very sloppy of me....just trying to determine if I should go in to the interview this unprepared....and ask for a continuance to clean up the mess. I really dropped the ball on this one....

You really didn't mention the middle name on the N-400? Neither in the main name section nor other names used? That can be a showstopper, because all your names are required to do a proper name check. They'll probably have to redo your name check, unless they already knew your middle name from your green card application or Social Security, and used that name in the naturalization name check.

All you can do at this point is bring it up at the interview, and they will decide whether a redo of the name check is necessary. And you should get a birth certificate printed by the issuing authority, or a letter of non-availability from them, as it is very likely they will ask for it and won't approve your case without it ... although it may be too late for that if your interview is in March.

Showstopper as in denial or showstopper as in new FBI name check and new interview dates? I am asking these questions so that someone else with my stupid situation can learn....what do you think?

Showstopper as in they won't be able to approve you right after the interview ... your approval will probably be delayed by a new name check and/or obtaining your birth certificate, which could result in a delay of several months.

Thanks Jackolantern...I pray I have an IO who is somewhat understanding. There is consistencey to an extent with my name....just that name left out....but you are right, name checks are important. Conseidering the timeline, I will not have enough time to take care of this. Interview is couple of weeks....all very disconcerting, but thanks for all your input.
