As the primary applicant I have just received my I-485 approval (EB2) from the TSC - a straight forward process (I-485 RD was 11/18/2005).
However my wife's case (dependent application) has been forwarded to a local office for interview.
By itself that is not a surprise as as a few years back she by accident overstayed her F1 visa (she tried to switch to a F2 but sent the forms to the wrong address) for less than 180 days. She got stopped by immigration, put into deportation proceedings and left the US on voluntary departure (granted by immigration judge). Since then she has been back on H4, H1 etc (every time getting the visa stamp was a real pain so thank good for AP).
So no question - she is eligible to get her GC (i.e less than 180 days out of status). However What I am wondering is what to expect during the Interview and what she should bring as far as documents are concerned.
I have already been approved as the primary applicant - so I am wondering whether all my tax records etc. will be necessary. Obviously she will have our marriage license, details from the immigrationt court, proof of her voluntary departure etc.
In addition should I be at the interview as well ?
Any thoughts ? Any experience in cases where the dependent has been interviewed rather than the primary applicant ?
