Hello everyone:
Lately, quite a few files are being transferred over to the local office for processing. Especially people with older priority dates are being victimized by the INS. Mostly, if the person does not have any criminal record, obtaining approval is easier.

Please post your details here and keep this thread alive.

PD 2/96 (EB2, MS, reg. LC took forever to clear)
I140-RD: 6/15/99
I140 RFE 7/99 (financial statement from company)
I140 Clear: 8/00
I485 RD: 9/00
I485 ND: 10/2/00
Interim EAD: obtained from westminster office
AP/EAD: aprroved
1 FP: 2/9/01
2 FP: 3/29/01
out of status: borderline (b1 stamp at port of entry instead of H1)
245i: not filed
Waiting for approval/RFE/transfer to local office

Husband\'s second O-1 approved on 9/00 but required us to leave usa to get it stamped. We did not do it.

Who decides about case being transferred to a local office for an interview? Is it a quality control department or an officer? Does case gets assigned to the officer and then get transffered, or it gets transffered before it gets assign?
Does anybody know?

after finger printing an office reviews the file. If there is something small he requires then he sends out a RFE, but if there are any abnormalities - like criminal record etc., then he transfers the case to the local office for interview. generall about 25% are transffered to local office - some of them are done just by random.

what i know in addition is if your PDs are pretty old ( guess more than 3-4 yrs ) they might want to check on your employment and will call u for interview..

yes. i heard the same thing too - a friend of mine with PD of May \'95 was called for interview at San Jose: the officer told him that the only reason he was called is to check if he had still stayed with the same company after so many years! and also to check if his job description had changed. since my friend answered that nothing had changed in his case, the officer simply approved his case. so, don\'t worry. everything will be all right...
