interview date before 5 years

My interview date will be 9/28 but my 5 years anniversary is 10/12.
What will happen after interview. Local office is columbus, ohio.

Most likely will be rejected with a recheduling. I would suggest that you reschedule it yourself so that your application does not end up in a black hole. Bring to their attention this fact and they will probably give you the following month's date.

Actually, that is more likely to result in a black hole. It's better to show up at the interview, let them conduct the interview if they want, and then the 120-day clock for 1447(b) would start ticking.
 
It is a type of lawsuit you can file to force USCIS to resolve your case if it's still pending for 120 days after the interview. When you file 1447(b) the case is placed under the supervision of a Federal court, so USCIS can't deny you just to get back at you for filing the lawsuit. With 1447(b) having been filed, the court itself can decide the case, or they can send it back to USCIS to decide it by a given deadline. Or USCIS might approve it before the court hearing.

Hello.

When I was checking the late post came crossed this post and decided to write down my situation.
I have recieved my interview letter last week and interview will be held on September 28th in San Francisco..My permanent residence start date is November 1st,2005 on my GC.Is it something I need to worry about it? It will be earlier than 5 years residence however within the previous 90 days which was allowed by USCIS.The date of the interview also doesn't mean we are going to USC because we need to wait to take the Oath,

Can you please anwer my question whether there is something we need to worry about it?

When you show up for the interview, either they'll tell you to go home and they'll schedule another date, or they'll conduct the interview but postpone the decision until after the 5 year mark. In either case, your case gets put on a back burner for a while and you just have to hope they don't let it sit idle for months.

Not a big deal...they will conduct your interview, but they will not be able to approve your case before 10/12. At the end of the interview, you will get a decision can not be made at this time...but everything else is alright, the officer will approve the case and send the decision/oath after 10/12...If you have mailed your application beforen the 3 months perion allowed, that is something else.....good luck
 
How about if they conduct the interview and schedule for Oath after 5 year mark? Is it something can ben done?

Yes, but an approval letter will normally be mailed to you. If you have an efficient officer, he will conduct the interview and note on your file, approval on the anniversary of your 5 years, and approve it on the day. In addition, send you an approval note on the day, with Oath date.

What I understood from all these post that there is no way for me to take the before November 1st,2010 which is 5 year mark since my permanent residence..Is that right?

Yes, USCIS can't administer the oath before the anniversary of your 5 years of LPR. Usually, depending on your DO, if you pass the civics test and everything check out well, and if your office conducts oath ceremonies daily, just hope for oath ceremony as soon as you clear Nov 1, 2010.

Thanks for your prompt response but another question came to my mind.How about if they won't notice that my 5 years still hasn't fullfilled and schedule the Oath before than 5 years mark.? Or eventhought isn't caught by them do I have to tell them that my 5 years mark is November 1 st?

It is possible that USCIS can make an oversight, which has happened to someone on this board I believe, he was sworn in days before his GC anniversary. In reading his posting, he never bothered to tell them and he was sworn-in and moved on. However, if this was to be your situation, I would advise you alert USCIS, because these things have a way of turning against you in the future. I don't see any advantage of being sworn in before your 5 yrs GC anniversary and couple of days or weeks thereafter, because your ultimate goal is US citizenship. I only see downside in riding an oversight on USCIS to be sworn-in before your 5 yr anniversary. I would argue that doing it the right way following all the laws, is the proper way to have a piece of mind. For example, if you decide to sponsor a spouse/parents and siblings, USCIS is likely going to delve into your file, which might lead them to discover this oversight, which though might cost them money and time, they might want to redo your citizenship due to this error. In the meantime, it will affect whoever stood to benefit from your sponsorship.

In a nutshell, follow all the legal channels necessary to be a legitimate citizen, a shortcut which might be illegal can come back to bite you like bed bugs are having a feast on people in the Ohio....lol!!!

Hello. Can you please tell us how did the interview go. Did they reschedule? How long after the interview did you have to wait before the oath letter? Thanks.
 
Hi Guys,

No worry at all!!!!!!!!!!

I checked most interview experience during past half year in this forum, there were too many similar cases. This is because your DO does not have that many pending cases so they actually are "over-efficient" which leads to this situation.

In all cases the interviews had been conducted as usual. At the end you will get a letter indicating you will receive oath letter in mail. And the oath letter will be sent out after 5 year mark.

Sit back and enjoy your life!
