My employer sent a company wide electronic notice of opening. How should I file 9089?

Is it acceptable to put a one day for internal recruitment? Would it be acceptable to state that the notice remained open for 30 days?

Can anyone tell me what they did?

no good!

Hi there,

It looks like your company really messed up here. The electronic notice is not usable as a posting notice under the regs. Even if it were it wasnt posted online for anywhere near 10 business days. If you file the 9089 with that and get auditied your employer will get in trouble.

Also, the emailed notice unfortunately cant be used to statisfy any of the other advertising requirements on the 9089.

The only thing I can really see that the notice satisfys is the extra requirement that most people forgot for the company to follow all inhouse recruitment procedures that usually do for the position.

However this doesnt really help for the 9089, it must be posted I'm afraid.

hope this helps

Just to clarify.

The “Notice of filling” was physically posted for 10 business days.

What I am confused is the “employee referral program”. 9089 asks for the dates “advertised” with employee referral program. My employer tells me he sent it off the person in charge and they are in charge of doing the distribution. As far as the “system” is concerned the position is still open until they have a permanent employee. However the distribution is electronic and the database too. As far as he concerned after 30 days a position is “stale”. Any ideas?

It is actually called a "Notice of Filing". It cannot be counted as an additional recruitment step. It is supposed to be posted for a least 10 consecutive business days" in the employer's premises on the notice boards. It should comply with all the requirements for "Notice of Filing" as specified in the PERM regulation such as ...Salary should be mentioned and must be greater than or equal to prevailing wage, etc.
