Internal Job Ad

For the PERM process, my company has posted an internal job ad online. However, it is very similar to the "Notice of Filing". I am thinking whether it would be considered as a valid online job ad (rather than Notice of Filing that is physically posted in premises of the company). The ad contains language such as "this notice is being posted because an application for permanent alien labor .... US Dept of Labor, Atlanta, GA". Below this, it lists the duties, qualifications, location, etc for the position advertised.

Will this just be considered as a notice of filing instead?
 
On your company's website, it should not say anything that it's being posted for the labor certification. It should simply list the job, its requirements, and how to apply for them.

How long should the ad run on company's web site? One day/One week/One month? The ad on local newspaper was run only one day (Monday).
 
What is "Notice of Filing"?

Is there a special way to post the job opening on-site? I was going to do copy and paste of the newspaper ad that my manager has created and print it on the company letterhead and post it on few places.

The ad has only title, job duties (it does not even say job duties, it just starts listing job duties right after the title), and person's name and the company address where it asks to mail their resumes. Total 8 lines with 100 words. Thanks.
 
Notice of Filing is a requirement of the PERM process and has specific language requirement. Your attorney should give this to your HR. It normally has a disclaimer that "This notice is being posted because an application for permanent alien labor certification has been filed ...." and it should provide the Dept of Labor's address (Chicago or Atlanta). Check with your attorney/HR.

As far as the ad you have mentioned that you will post on a few bulletin boards, what recruitment step does it satisfy? Is that for employee referral program? I know you can place the ad online at your company's website but didn't know you had to place it physically unless it is a notice of filing. BTW, HR should be doing this.

"Employers are required to place a job order with the SWA, place a notice of posting at the worksite, and run two newspaper advertisements in Sunday papers." Only thing we have not done is the notice of posting at the worksite.

And three from the followings (but we have done four):
Job fairs
Employer's web site
Job search website other than the employer's

On-campus recruiting
Trade or professional organizations
Private employment firms
Employee referral program with incentives
Campus placement offices
Local and ethnic newspapers
Radio and television advertising


I do not have an immigration lawyer and the HR does not know anything about PERM and GC process. Company's patent lawyer is helping me in this process, but I am trying to help him by finding current information online/forum as he does not know much about immigration law/rules.

The online company website should not mention the LC. For the "Notice of Job Opening," that should have that text in it, yes, and should be posted internally in a public area for a minimum of 10 business days. The company website we usually do for a month or a minimum of 15 days.

How would I figure out what address to put?

OR can I just post the job ad as it was on the newspaper (short one) and add wage ranges and post it on the job bulletin board at my work place? Thanks.

That sample you found is fine. The Chicago Processing Center is no longer processing new applications, so the Atlanta address should be mentioned.

At the end of the form, it asks for number of applicants recevied. How would we know how many applicants as it has not even posted yet or am I missing something the reason of this filling notice?

Thanks. Does that mean my manager needs to send (or chose online) the Atlanta Processing Center for my LC application?
 
nixone: The center (chicago or atlanta) where you apply depends on which state you reside in. However as st4rguitar mentioned, atlanta may be the only option if chicago is not accepting new applications. I assume after you have posted the NOF for 10 business days, you will fill in the # applicants who applied for the position. I am not much aware of the laws but that is my simple interpretation. st4rguitar can correct me if I am wrong.

st4rguitar: For the alternate step "Job search website other than the employer's", is it okay if we ran the online ad on NY Times' website for 2 weeks (in conjunction with 2 consecutive sundays in print)? My understanding is that it would count as 1 of 3 steps.

Does USCIS ask for a proof that the Notice of Filing was posted for 10 business days (if case is audited?). Do you actually take photos everyday of the bulletin board where NOF was posted and the timestamp of photos serve as proof?

Yes, the NY times site posted in conjunction with the ads counts as a job search website.
No, we don't take pictures of the posting. At the bottom we have the employer sign the document stating where posted, the dates posted, the number of applicants, and the employer's signature.
