Interim EAD

Hi,
If my EAD doesn't get approved within 90days am I eligible for interim EAD on the 90th day or the 91 st day. I am from Phoenix, AZ.

Also do they count the receipt date or the notice date from which they count 90days.


Please help.
 
My EAD receipt date is April 16th and notice date is April 18th. Am I eligible to get interim EAD on July 15th which is the 90th day from April16th. I am worried as I am current EAD expires on July 14th.

This is what the law states

Interim EAD: If BCIS does not approve or deny your EAD application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim EAD document.

So technically, 91st day, but I bet if you showed up on the 90th day, the chances of your getting iEad are pretty high. Explain them your situation.
 
Thank You. I will try. I went to the INS office once and she asked me to come back on JUly 17th as my application was filed on April 16th. Yesterday I realized that there are 31 days in MAY so my 90 th day would be July 15th and 91st day July 16th. I will go and try next week to take an appointment.

This reminds me of something - I've seen it many times on this forum - you're good to work with the same employer even if your EAD has expired as long as you've applied for renewal.
Would that be correct?
