hi fellas,
my case is of I-485/I-140 concurrent filing at TSC. the I-765 (for my wife, currently on H4) receipt says it will take 80days to process it. next week the 80 days period will be over. does anyone of you know if we can go the local INS office and get an interim EAD for her after the 80 days period is over.

btw, if anyone got EAD approved recently, please update us.
thanks.

thanks very much in advance.

Fingerprinting has not been done. I heard at
TSC fingerprinting is taking about one year
from the receipt date of I485.

My I140 has not been approved yet.

The receipt date is 10/31/02 both for 485 and 765.

Thanks.

rboehliat,

You will have to wait for 90 days before you can go to local INS for interim EAD.

For concurrent filers, looks like they are not approving EAD or AP untill I140 is approved (happened with me and a couple of others I know). But you can still get an interim EAD after 90 days.

Thanks a lot. Do you know how long is the
interim EAD valid for?

To get interim EAD what else do I need to take
besides these:

1. I-485 receipt
2. I-765 receipt
3. Passport

There is no fee for interim EAD right?

I appreciate your answering these. Thanks a
bunch in advance.

rboehliat,

The interim EAD is usually valid for 8 months. But a couple of my friends got it for only 3 months. I guess it depends on which city you are in (I'm in Houston).

No, there is no fees for Interim EAD.

You will also need a letter from your employer stating that you will be removed from payroll if your EAD is not approved by so and so date.

Check earlier posts for experiences in various cities.
