Interim EAD while RFE is issued on I140 ?

Is it possible to apply for interim EAD while RFE is issued on I140 ?
Or how long should i wait to apply for interim EAD after RFE has been replied ?

Well, technically they may refuse to issue I EAD if they know that there is an RFE on I-140, but there is no harm in trying.

btw, my ND is Sep 26 2003, I got my EAD and AP approved but they never touched my I140,but looks like they touched your, what different did you do??????

Hopefully you must get ur I140 approved in next month or so.

I think the difference may about labor, mine is labor substitute.
The orginal labor was approved in 2000 year, but my lawer did not attach any 2000 year company financial statements. So, INS RFE'ed my application requestting company's ability to pay the amount shown labor in 2000 year.

how much was gross and how much net income of the co. ?

I have no information about company profit numbers in that year. But my employer told me that they have more than enough profits to satisfy the amount shown in Labor

I tried for my interim EAD while I have RFE on my I-140. They rejected because my case is onhold. They told me that my case is on hold, they cannot issue interim EAD. Now, I got I-140 approval yesterday. I am planning to try again.

Do NOT give the I140 RECT Notice.Got to centers like SANTA AN ,CA,They do not ask for 140 RECPT Notice
