interim EAD question

I applied extension of my EAD last year (2004)in May through the NSC, got receipt in June. It's extension for 3rd EAD. It's still pending to this day. I had to go to local Disctrict office in San Antonio, Tx to get interim EADs. I had to do that 3 times. The last time last Monday 2/28/05. Usually they gave me the interim EADs, not much question asked for 3 months. This time around, the officer told me that it's the last interim EAD they'll give me, and it's only for 60 days. He told me I have to write NSC to let them know of the situation. The also told me I should reapply new EAD, submit new forms and application fee. Anyone has similar experiences? Is there a limit on how many EADs a district office can give? He told me the limit is 240 days.

I asked him how do I submit another application for I765, which means they'll be 2 pending with NSC, & what will happen. He don't know the answer to that. I asked if they'll give me interim EAD if I apply for new ones, he said no. Any advice from you guys will be appreciated.

Also I've written letter to NSC asking about my pending EAD, with receipt no. etc. No response yet. Calling the 800 number does no good at all, they just return a print out of 'we sent you a receipt, blah, blah...'. Basically a print out of what I can get from the uscis.gov site. What should I do?

I don't know what's going on with NSC or my case. My I485 Notice date is 8/22/02. I got 2nd fingerprint last June. Since then no activity on my case at all. The Last Updated Date is still last June. It's been real frustrating. It seems like my EAD is not processed, neither is my I485. I was hoping that something will happen by end of year last year. I kept reading people getting 485 approved soon after getting 2nd finger print.

Write to the Center Director

You should write a polite letter to the Center Director explaining the situation. send it by certified mail and you will see for sure, LUD changes. I hope something good will happen after that. I did that and I saw LUD changes in my case.

I wrote a letter, very polite and professional and resent it to the same address as I would if applying for new EAD. No response yet.

How do I get the address and name to Director of Service Center. Please help. Thanks.

I wrote on top of the envelope "For the Personal Attention of The Director"

You may in fact, write his name on the top. Please see that this is a different P.O Box from where you submit applications.

contact your local congressman as soon as possible. even maybe tomorrow. fax them or make an appointment, and explain your situation with 485 and EAD. your 485 is pretty late, it should have been approved already. good luck

how do I go about contacting the congressman? If I just find his/her office number and scheduled an appointment, will they understand what I'll be talking about? EAD, 485, etc. Are they familliar with all this?

Questions on interim: Are they limits on how many a local district office can issue to pending cases? What should I do? Should I apply for new EAD? Really, I'll write the Center Director, contact my congressman and probably apply new EAD if it's advisable.
 
yes, I am sure they are familiar with those terms. but make sure you give them detailed information like your A# number etc. if they can't schedule an appointment, just fax them and call them to check if they received it. and mention that this is urgent, and call them back periodically to check on the status.

if they can't come up with an answer(they should be able to) apply for another EAD, if that one doesn't get approved in 90 days either, then schedule another appointment to get your interim at a different office(that's what I did when I was getting mine as a backup). usually local offices give one interim EAD per office.
they gave me an 8 month one and last week I got the original application approved luckily.

I am thinking you may even get your 485 approved before your EAD if you contact your congressman, bcuz you have been waiting too long. keep us posted, good luck
